Scope

All deliveries and achievements from ERLINDA in accomplishment of assignments, which has no connection with a customer's commercial or independent occupation, are based on these Terms of Payment and Deliveries (TPD). All additional agreements, particularly concerning terms of payment - explicitly require our written confirmation.

Right of return and cancelation

30 days after receipt of goods without any reason according to § 13 BGB (Germany). In case of a return the already provided payment by a customer will be retransfered within a period of 30 days after receiving the goods.

The customer has the right to send back the goods at our risk, if the amount of the ordered goods does not exceed the value of 40,00 EURO. Furthermore the customer has to shoulder the costs of the redelivery. By a value of more than 40,00 EURO or wrong delivery, ERLINDA covers the expenses for the redelivery.

In the case that damaged or faded goods are returned to us, the legal and permitted sum will be deducted. This can be avoided when the customer checks the goods on delivery as is usual in all stores. Returned goods must have no signs of use and must be returned in its original packaging.

Excluded from the return

Goods which are custom made or specifically made for personal use, products of a certain consistency, as well as opened packaging and used goods cannot be sent back.

Signing of a contract

We get an obliged order for the goods in your "shopping basket" after you send your personal data by pressing the "submit" button. After transmitting your order, you get an order confirmation. The bill of sale is signed by getting the order confirmation or by delivery of our goods.

Guaranty

By this consumer guarantee, ERLINDA guarantees each product to be free from defects in materials and workmanship for a period of 1(one) year from the time of its original purchase.

If during this period of guarantee a product proves defective due to improper materials or workmanship, we will without charge for labour or parts, repair or replace the product or its defective parts upon the term and conditions set out below. ERLINDA reserves the right (at its sole discretion) to replace defect products with either new or recycled spare parts or products.

Legal arrangement

For all arising jurisdictional actions, such as payment, fulfillment, drafts and cheque actions as from this contract between traders, legal persons of communal rights or communal legal fiscal policy will exclusively place the trial for all of these commercial connections proceeding legal action, the seat of the company ERLINDA cutlery, Solingen, is thus appointed as court of justice: SOLINGEN (Germany) insofar as no other competent court has been confirmed by us.
